What is the Rebellion Act of 1807?

The act passed in 1807 gives the US President the right to deploy army and national guards in the event of domestic violence, rebellion or unrest. Its purpose is to empower the federal government under the circumstances when the state governments are unable to maintain law and order. The Act was used in the 1950-60s during the Civil Rights Movement and in the 1992 Los Angeles riots.

Immediately after assuming the presidency on 20 January 2025, Trump signed an executive order declaring a national emergency on the southern border. The order stated that within 90 days, the Defense Secretary and Homeland Security Secretary would report to the President on the position of the southern border, including recommendations on the possible use of the 1807 Revolt Act.

Difference between martial law & rebellion act

The administrative control in martial law goes into the hands of the army, while the army only assists civil administration under the Revolt Act. In this, the power to decide is with the President, and the army is used to maintain law and order.
